Delhi Court Grants Bail in 65 Lakh Cheating Case

(State Vs Abhinay Jaiswar, order dated September 25, 2025)

65 Lakh Cheating

The Patiala House Courts, Delhi, on September 25, 2025, heard a bail application in a case where the accused was alleged to have received a sum of Rs. 65 lakh in a bank account linked to his name. The Additional Chief Judicial Magistrate (ACJM) Pranav Joshi granted bail, observing that the accused had no prior criminal record and that no purpose would be served by keeping him in custody, as the investigation had been completed and the chargesheets were filed.

The accused was arrested on the grounds that a sum of Rs. 65 lakhs had been received in a bank account linked to his name, although the mobile number associated with the account did not belong to him. He submitted that he had been falsely implicated, his name appearing in the case solely due to his connection with the co-accused, and contended that since the case is entirely based on documentary evidence with no possibility of tampering and the trial had not yet commenced, there was no justification for his continued custody. The accused further emphasized that he had no criminal record, was a permanent resident with a fixed address, and posed no flight risk, and, having been in custody since 05.07.2025, argued that in light of the fact that the co-accused had already been granted bail, he too was entitled to the same relief on the ground of parity.

The Court, after considering these contentions, granted bail to the accused subject to directions that he shall not threaten or induce anyone acquainted with the facts of the case to withhold information, shall not tamper with evidence, and shall refrain from committing any similar offence. The accused was further directed to appear on each date of hearing, inform the Court of any change in his place of residence, provide accurate communication details, seek permission from the Court before leaving the country, and cooperate with the investigation as required. With these conditions, the Court granted bail to the accused for a sum of Rs. 30,000, and the application was disposed of with a copy of the order to be returned to the Court of ACJM.
