Supreme Court Cancels Bail in Multi-Crore Cheating Case; Orders Judicial Training and Police Probe

Bail Cancelled Cheating

The Supreme Court set aside bail orders granted to two accused in a high-profile cheating case involving over ₹6 crore against Netsity Systems Pvt. Ltd. The Court found serious lapses and procedural irregularities at every stage trial court, Sessions court, and High Court holding that all three had failed to properly assess the gravity of the charges, the accused’s conduct, and the material evidence on record.

The bench noted that the accused repeatedly gave false undertakings, misused interim protection to evade repayment despite clear assurances during mediation, and carried a prior criminal history. In such circumstances, the bail orders were deemed “unsustainable.”

Directing both accused to surrender within two weeks, the Court also issued systemic corrective measures. The Chief Justice of the Delhi High Court has been asked to organize a special seven-day judicial training programme for the officers who passed the flawed bail orders, to reinforce sensitivity and adherence to binding precedent. Further, the Commissioner of Delhi Police must conduct an urgent inquiry into the investigating officers’ conduct and take appropriate action.

Emphasizing that bail decisions must be rooted in a fact-driven assessment rather than mechanical application of principles, the Court described the present case as one warranting a departure from conventional bail jurisprudence given the egregious misuse of process.
