Delhi HC Seeks Clarity on Notification of Implementation of Data Protection Act Provisions

The Delhi High Court directed the Union of India to clarify whether any notification has been issued to bring into force provisions of the Digital Personal Data Protection Act, 2023.

A Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela was hearing a writ petition when it observed that under Section 1(2) of the Act, its provisions come into effect only from dates notified by the Central Government, which may differ for different provisions.

The Court recorded that, so far, no such notification had been placed on record. It therefore asked counsel for the Union to verify not only whether any notification under Section 1(2) had been issued, but also whether the Government contemplated issuing one.

The matter is scheduled for further hearing on November 12, 2025.
