The Patiala House Courts granted bail to accused in rash and negligent driving causing a fatal accident in which one died and his wife sustained injuries. The accident occurred on September 14, 2025, when accused’s BMW collided with the couple’s motorcycle near Ring Road, Delhi Cantt. The prosecution alleged that the BMW was driven at over double the allowed speed of 50 kmph, leading to a fatal collision and subsequent denial of timely medical aid, including diversion of the victims to a small nursing home linked to accused’s relatives.
Significant CCTV evidence showed the car lost control, flipped, and struck the motorcycle, contradicting initial prosecution claims of outright deliberate ramming. The footage also revealed troubling conduct by ambulance paramedics present, who failed to provide medical assistance and left the scene within 40 seconds, undermining the prosecution’s claim that delayed medical care by the accused caused the death.
The Court weighed the objective evidence, the accused’s established roots in society, lack of criminal antecedents, and the documentary nature of ongoing investigations to conclude bail was appropriate with the accused’s cooperation presumed. Bail conditions include restriction from contacting hospital staff and witnesses, regular cooperation with police investigation, passport surrender, and weekly check-ins with the investigating officer. The accused’s bail was accepted with a bond of Rs. 1,00,000 and two sureties of the same amount.
