The Delhi High Court has issued notice in a writ petition filed by Rahul Yadav and his father, seeking quashing of FIR No. 0258/2025, registered on 15 May 2025 at P.S. Jagatpuri, under Sections 64(2), 79, 123, and 351(2) of the Bhartiya Nyaya Sanhita, 2023. The FIR was lodged by a woman alleging rape and related offences.
In the petition, the petitioners contend that the relationship between Rahul Yadav and the complainant was consensual and that the FIR was filed with malicious intent following the breakdown of the relationship. It was also alleged that the complainant’s family had earlier threatened to implicate him in a false case after he declined to meet financial and matrimonial demands.
The petition refers to inconsistencies in the timeline of events, delay in filing the FIR, and absence of corroborative material evidence. The petitioners have relied on WhatsApp and Telegram chats and police diary entries to establish an ongoing consensual relationship and alibi during the period in question.
The High Court has sought responses from the State of NCT of Delhi and the complainant. The matter is likely to be heard in the coming days.
