Centre notifies Comprehensive Directive for Efficient Litigation Management Across Government Departments

The Ministry of Law and Justice has issued a comprehensive Directive for the Efficient and Effective Management of Litigation by the Government of India (2025) to streamline legal processes and reduce the burden of avoidable litigation across Ministries, Departments, and autonomous bodies of the Central Government.

The Directive aims to improve coordination, reduce delays, promote accountability, and institutionalize best practices for litigation handling. It seeks to enhance good governance by reducing recurring litigation, avoiding unnecessary appeals, and establishing legal cells and nodal officers within ministries for case monitoring.

Key features include:

  • Creation of dedicated legal cells and nodal officers in all ministries.

  • Use of LIMBS (Legal Information Management & Briefing System) for real-time litigation tracking and coordination.

  • Promotion of Alternative Dispute Resolution (ADR) mechanisms such as mediation and institutional arbitration.

  • Establishment of a pecuniary threshold and risk-based criteria for filing appeals and Special Leave Petitions.

  • Mandatory root cause analysis of significant adverse litigation outcomes.

  • Focus on contractual dispute prevention, grievance redressal, and proper compliance with court orders.

  • Annual reviews, legal training, performance evaluation of panel counsels, and formulation of amnesty schemes to reduce pendency.

The Directive is applicable to all Central Government departments, attached and subordinate offices, and CPSEs for arbitration matters. State Governments have been encouraged to consider adopting similar mechanisms. An annual compliance report will be placed before the Committee of Secretaries chaired by the Cabinet Secretary.
