The Supreme Court expressed strong reservations over a petition seeking the registration of a First Information Report (FIR) against sitting judges of the Delhi High Court. A Bench comprising Justices Surya Kant and Joymalya Bagchi questioned the maintainability of the plea, particularly the legal basis for prosecuting judges for their judicial decisions.
The petitioner had alleged that he was the topper in an examination but was denied relief by various High Court judges, prompting his request for criminal action against them. The plea named sitting High Court judges as respondents and alleged judicial bias.
The Bench observed that the petition was unclear in its formulation and that the relief sought initiation of criminal proceedings against judges for delivering judgments was legally untenable. In view of the complexity of the issues raised and the lack of clarity in the petition, the Court appointed Senior Advocate Dr. S. Muralidhar as amicus curiae to assist the Court.
