Supreme Court issues Notice in NHAI’s Challenge to Madras HC Order on Highway Barricade Removal

The Supreme Court on 17 July 2025 issued notice in a plea filed by the National Highways Authority of India (NHAI), challenging a judgment of the Madras High Court (Madurai Bench) dated 19 February 2025. The High Court had directed the removal of highway barricades placed in front of a private property, holding them to be obstructions.

A Bench comprising Justice Surya Kant and Justice Joymalya Bagchi heard senior counsel Ms. Pinky Anand for the petitioners and Mr. M.P. Partibhan for the respondents. The Court granted NHAI two weeks to file an additional affidavit in response to the photographs submitted by the respondents. The respondents were also permitted to file a counter affidavit to clarify the ownership rights over the land abutting their property.

In the interim, the Court directed that status quo be maintained and listed the matter for further hearing on 19 September 2025.
