In a major relief to the Mamata Banerjee-led West Bengal Government, the Supreme Court stayed a Calcutta High Court judgment that had halted the operation of a new list of Other Backward Classes (OBCs) issued by the West Bengal Backward Classes Commission.
A bench led by Chief Justice Gavai observed that the High Court’s decision was “surprising” and “erroneous”, holding that it violated the principles laid down in the landmark Indira Sawhney judgment, which governs OBC classification.
