Delhi Court Discharges Five in Kishangarh Firing Case, Frames Attempt to Murder Charges Against Four Others

The Patiala House Courts, New Delhi delivered its order on charge in the 2021 Kishangarh firing case, discharging five accused for lack of evidence while directing four others to stand trial for attempt to murder and offences under the Arms Act. The incident, which took place near Negi Dhaba in Kishangarh, involved a targeted attack on complainant’s vehicle and left his driver injured.

Additional Sessions Judge Kiran Gupta found no prima facie evidence of conspiracy against five accused persons apart from disclosure statements of co-accused. In the absence of independent corroboration such as call records, location data, or recoveries, they were discharged of all offences, including conspiracy under Section 120B IPC.

However, the Court held that prima facie charges under Sections 307/34 IPC and Section 27 Arms Act were made out against four accused persons. CCTV footage and recoveries of arms and ammunition linked them directly to the firing, which injured driver.

Accordingly, while five accused stand discharged, four others will face trial for attempt to murder and use of illegal firearms.
