NCLT Bar Association Urges Immediate Action on Infrastructure Crisis at NCLT New Delhi

NCLT Infrastructure Crisis

The National Company Law Tribunal Bar Association (NCLTBA) On September 4 2025, submitted an urgent representation to the Ministry of Corporate Affairs highlighting the severe infrastructure breakdown at the National Company Law Tribunal, New Delhi.

The Association pointed out that, pursuant to a public notice dated September 3 2025, Court Nos. IV, V, and VI located on the 8th floor of Block 3, CGO Complex, Lodhi Road, were declared unsafe due to roof seepage, rendering them non-functional. With the NCLT already operating from cramped premises, only three courtrooms on the 6th and 7th floors are presently functional against the sanctioned strength of six. As a result, all benches are functioning on a half-day basis, leading to near paralysis of judicial proceedings.The representation also recorded the lack of basic facilities such as a bar room, canteen, photocopying services, and adequate administrative space. It noted that although the Delhi High Court, in PIL No. 6037 of 2018, had directed allocation of the First Floor of the building for NCLT use, renovation has stalled and possession has not been handed over. NCLTBA warned that the present situation effectively denies citizens access to justice under Article 39A of the Constitution.

The NCLTBA urged immediate remedial steps and warned that continued inaction would compel it to take necessary measures to restore judicial operations. Copies of the representation were also forwarded to the Chief Justice of India, the Finance and Corporate Affairs Minister, the President of the NCLT, and senior officers of the Ministry.
