The Supreme Court has issued notice in a challenge to a Rajasthan High Court order quashing an FIR on the basis of a forensic report.
The case arises from FIR lodged at Rajiasar Police Station, Sriganganagar, against Harpat Ram, a Revenue Officer, (“Respondent”) on allegations of forgery of land records. The document in question was sent to the Forensic Science Laboratory (FSL) for handwriting analysis.
In its report, the FSL, supported by the Superintendent of Police, concluded that the allegations against the officer were not borne out. Relying on this, Justice Farjand Ali of the Rajasthan High Court (Jodhpur Bench) on March 26, 2025, held that continuation of proceedings would serve no purpose and quashed the FIR and all consequential proceedings against Respondent.
The complainant, Nek Mohammad, moved the Supreme Court challenging the High Court’s decision. On September 8, 2025, a Bench of Justices Prashant Kumar Mishra and Vipul M. Pancholi condoned the delay and issued notice returnable in six weeks in the matter.
The Supreme Court will now examine whether the High Court was justified in quashing the FIR solely on the strength of the FSL report despite contrary opinions expressed by the investigating officer during the course of investigation.
