Punjab & Haryana HC Allows Minor Student to Resume Classes; Affirms Strict Behavioural Conditions Imposed by School

The Punjab and Haryana High Court has permitted a Class 12 student, accused of repeated instances of unruly behaviour and violence in school, to rejoin classes, subject to strict disciplinary conditions.

Justice Kuldeep Tiwari was hearing a writ petition filed by the minor student through his mother. He challenged a series of show-cause notices issued by the school in July and August 2025 under CBSE guidelines.

During the hearing, the Court interacted with the student and his mother, who assured that there would be no repetition of misconduct. The school authorities, while stressing their responsibility to ensure discipline and safety of fellow students, agreed to allow his return under stringent conditions.

The conditions imposed include:

• No further acts of bullying, aggression, or indiscipline.

• Strict disciplinary probation for the remainder of the academic year.

• Monthly behavioural reports by the school counsellor.

• Mandatory counselling sessions.

• A written apology to the principal, staff, and student community.

The Court clarified that while these conditions were reasonable, additional restrictions such as limiting participation in school activities or withholding character certificates were unnecessary at this stage.

The bench directed that the student be allowed to resume classes from September 22, 2025. The Court emphasised that the order was aimed at safeguarding both the academic future of the minor and the interests of the larger student community.
