The Allahabad High Court rejected the bail plea of Ansar Ahmad Siddique, a 62-year-old man accused of promoting anti-national sentiments through a Facebook post allegedly supporting Pakistan and propagating “Zihad.” The post was shared shortly after a terrorist attack in Srinagar that claimed 26 lives, prompting authorities to allege that the applicant’s actions indirectly endorsed terrorist activity on religious grounds.
The Court while denying bail, observed that such conduct violates fundamental duties under Article 51A of the Constitution, particularly the obligation to uphold the sovereignty, unity, and integrity of India. The Court noted that despite being a senior citizen born in independent India, the applicant’s actions were irresponsible and disrespectful to constitutional ideals and did not warrant protection under Article 21, which guarantees the right to personal liberty.
The Court directed the Trial court conclude proceedings expeditiously in accordance with Section 346 B.N.S.S./309 Cr.P.C.
The Court further noted that the Commission of such offences is becoming routine affair in this country because the courts are liberal and tolerant towards such acts of people with anti national bent of mind. It is not a fit case for enlarging the applicant on bail at this stage.
