The Bombay High Court has come down heavily on the Maharashtra police for failing to comply with statutory mandates regarding maintenance of case diaries, and has now sought a formal explanation from the Director General of Police (DGP). A division bench of Justices Ajay Gadkari and Justice Rajesh Patilhas directed the DGP to submit a statement on oath clarifying whether the provisions of law enacted by the Parliament of India are binding and mandatory on police personnel in the State of Maharashtra.
Expressing strong disapproval, the Court observed: “Police personnel themselves are not following the discipline and are not following the mandatory directions issued by the office of the Director General of Police.”
The aforesaid remarks came during the hearing of quashing petitions, the Court called up from Investigation Officer to show case diary and directed DGP maharahstra Police to file the Affidavit in reply to the petition.
The matter will be taken up further after the DGP files the required affidavit.
