Advocate Misused Social Media Platforms Causing Grave Infraction Towards Court’s Dignity; Delhi HC Warns Of Serious Consequences

The Delhi High Court took serious objections against advocates for misusing the social media platforms, where they made a Facebook Post, implying that a judgment would be delivered in their favour, and stated that the dictation of the judgment is under their knowledge through alleged reliable sources, when the hearing in the case is still underway.

The Court strongly said that such prejudicial action of the advocate is a grave infraction towards the dignity of the Court, and he will have to face serious consequences for concocting any such knowledge as suggested in the Facebook post, and in doing so, making the same public.

A Single Judge Bench of Justice Mini Pushkarna observed that an advocate by profession is bound by the rules and regulations of the Bar Council of India and has a bounden duty to maintain decorum in and out of the Court. Hence, the action undertaken by him, by making a public post with the tenor of mendacity, is an irresponsible act on the part of a party to a proceeding, much less an advocate.

The Bench was inclined to initiate contempt proceedings against the advocate and also refer the matter to the Bar Council of India. However, the said advocate, along with the other counsels, who are appearing for the petitioners, have profusely apologised and have tendered an unconditional apology.

Though the Bench was not inclined to accept the said apology, however, considering the nature of the dispute, it accepted the apology and cautioned the concerned advocate not to circulate any such posts or false information on social media or public platforms, which affect the dignity of the Court in any manner.

With such strong directions, the Court listed the original matter for hearing on December 22, 2025.
