The Supreme Court of India has held that the Air Force Group Insurance Society qualifies as a “State” under Article 12 of the Constitution of India, bringing the organisation within the ambit of constitutional scrutiny and enabling members to invoke fundamental rights against it.

The judgment was delivered by a Bench comprising Justice Sanjay Karol and Justice Vipul Pancholi in SLP (C) No. 27366 of 2023.

The petitioners were represented by Senior Advocate Shoeb Alam and Advocate Udai Khanna, while Sourav Roy appeared as the Advocate-on-Record.
