Allahabad High Court Quashes Minority Welfare Officer’s Order Closing Unrecognised Madrasa; Denies Grant Until Recognition

In a writ petition filed before the Lucknow Bench of Allahabad High Court to challenge the validity of an order dated 01-05-2025 by the District Minority Welfare Officer, Shrawasti, whereby the petitioner was directed to close the operation of its Madrasa, which was being operated without any recognition, a Single Judge Bench of Justice Subhash Vidyarthi allowed the petition and quashed the impugned order.

The petitioner submitted that, as per Regulation 13 of the Uttar Pradesh Non-Governmental Arabic and Persian Madarsa Recognition, Administration and Services Regulation, 2016, an unrecognized madrasa is not entitled to receive any grant from the State, but the same shall not result in its closure.

The Court quashed the impugned order and clarified that the petitioner madrasa would not be entitled to claim any government grant until it is recognized, and that the Madrasa Education Board would not be obliged to permit the students of the petitioner madrasa in examinations. It was also mentioned that the students would not be entitled to claim the benefit of their qualification acquired from the madrasa for any purpose related to the State Government.

Lastly, the Court stated that the seal put on the madrasa would be opened within 24 hours of production of a certified copy of this order.
