Bail Cancelled after two years; Supreme Court Refuses to Intervene

Mahesh v. State of Rajasthan [Decided on April 25,2025]

On 28 April 2025, the Supreme Court of India dismissed a special leave petition (SLP) filed by the petitioner challenging an order passed by the Rajasthan High Court cancelling his bail. The matter was heard by a Bench comprising Justice Ahsanuddin Amanullah and Justice Prashant Kumar Mishra.

The petitioner had been granted bail on 24 May 2022, but the High Court, through a detailed order dated 9 May 2024, subsequently cancelled the bail. The cancellation was challenged before the Supreme Court.

The petitioner’s counsel argued that the cancellation came two years after the grant of bail and that the High Court had not adequately addressed any new grounds justifying such cancellation. It was further submitted that the only recovery made was a country-made pistol and that, based on the post-mortem report indicating “blackening and tattooing,” the shot appeared to have been fired from close range, which contradicted the prosecution’s theory of a distant shot.

However, the Supreme Court noted that the High Court had provided well-reasoned and detailed justification for the cancellation of bail. The Bench observed no error or arbitrariness in the High Court’s reasoning and found no ground for interference.

Accordingly, the delay in filing the petition was condoned, but the Special Leave Petition was dismissed on merits. All connected interim applications were also disposed of.
