CAT Jammu Stays School Education Dept’s Transfer Order Affecting Three Teachers

Rakesh Kumar v. School Education Department [Order dated 25, 07. 2025]

The Central Administrative Tribunal (CAT), Jammu Bench stayed the operation of Government Order No. 238-DSEJ of 2025 dated July 14, 2025, issued by the School Education Department, insofar as it pertained to applicants.

The Tribunal passed the interim order where the applicants challenged the impugned transfer order alleging that it was issued without assigning any reasons, and contrary to an earlier order dated July 9, 2025, which had already sanctioned their reciprocal inter/intra-zonal transfers. The applicants stated that they had been relieved and joined at their new postings in compliance with the earlier directive.

The Tribunal granted four weeks’ time to the respondents to file objections and listed the matter for further hearing on September 4, 2025. In the interim, the impugned transfer order has been stayed as regards the applicants, subject to any modifications upon submissions from the respondents.

The order was pronounced by Member (A) Pragya Sahay Saksena and Member (J) Sanjeev Gupta.
