CBI Moves Delhi High Court Against Discharge of All 23 Accused in Delhi Excise Policy Case

The Central Bureau of Investigation has moved the Delhi High Court challenging a Special Court order that discharged all 23 accused in the Delhi Excise Policy case, contending that the trial court committed serious legal errors by conducting a “mini-trial” at the stage of framing of charges.

The criminal revision petition assails the order dated February 27, 2026, passed by the Special Judge (PC Act), CBI–23, Rouse Avenue Courts, in CBI Case No. 56 of 2022, arising out of FIR RC-003 2022 A 0053. The Special Court had discharged all accused, including senior politicians, bureaucrats and private individuals, after hearing arguments on charge.

The CBI has also objected to adverse remarks made by the Special Court against the investigating agency and the Investigating Officer, submitting that such observations were unwarranted and stemmed from a misreading of both facts and law.

The matter is expected to be taken up by the Delhi High Court in due course.
