Delhi Court Orders Judicial Custody for Husband Booked for Cruelty and Abetment to Suicide Following Wife’s Death at Home

The Karkardooma Courts of Delhi on October 25, 2025 allowed an application by an I.O (Investigation Officer) who had made an arrest under Sections 85 (abetment of suicide) and 108 (cruelty by a husband or his relatives) against the husband of a woman who was found dead by suicide. Sh. Satendra Pal Singh, Ld JMFC acknowledged the arrest due to the ongoing investigation and remanded the accused husband to judicial custody.

The case originated on October 22, 2025, at 8:20 PM when an FIR was registered at Laxmi Nagar Police Station, East Delhi, by the mother of a 29-year-old woman against her husband. The deceased had reportedly struggled with alcohol and drug addiction and was frequently assaulted by her husband, upon whom she was financially dependent.A day earlier, on October 21, 2025, the husband called the deceased’s father stating that she was not responding to his calls or opening the door, after he had left their home the previous night following a quarrel. The same afternoon, when the deceased’s brother reached her apartment, he found her hanging from a ceiling fan while husband was present at the scene and appeared to be under the influence of alcohol when the police arrived.The police crime team later seized key evidence from the scene, while the SDM recorded statements from the deceased’s family and closely examined the circumstances surrounding her death. The SDM concluded that offences fell under Sections 85 and 108 of the Bharatiya Nyaya Sanhita, 2023 following which the accused husband was arrested on October 24, 2025.The I.O informed the Court that the arrest was essential for proper investigation and to ensure the accused’s presence during proceedings, and that both the grounds of arrest and information of his detention were duly communicated to him and his cousin.

The Court stated that considering the Post-Mortem report was awaited, the suicide note was yet to be authenticated by FSL and the investigation was still ongoing, the possibility of accused fleeing the process of law could not be ruled out. Therefore, the Court remanded the accused to judicial custody for 14 days and directed him to be produced before Court on November 7, 2025. Accordingly, the Court directed a custody warrant to be prepared, a copy of the order to be given I.O and disposed of the application.
