The Delhi High Court has granted bail to a man accused of repeatedly establishing physical relations with a woman under the alleged false promise of marriage. Justice Sanjeev Narula, while allowing the bail application, observed that the case primarily rests on oral versions of the parties and lacks medical or forensic corroboration.
The FIR, registered at P.S. Moti Nagar under Section 376(2)(n) of the IPC, alleged that the accused maintained physical relations with the complainant between July 2023 and September 2025 on a false assurance of marriage. The Court noted that although the medical examination reiterated the allegations, the complainant had declined internal examination, leaving no medical evidence to substantiate the charge.
The Court also highlighted that the accused had been in custody since September 30, 2025, and the investigation was complete with the draft chargesheet ready. Justice Narula held that further detention would serve no useful purpose, especially as the allegations did not prima facie indicate forcible sexual assault.
While granting bail on a personal bond of ₹25,000 with sureties, the Court imposed strict conditions, including a prohibition on contacting the victim, residing within three kilometres of her residence, and mandatory attendance at the local police station thrice a month.
