The Delhi High Court on Friday strongly criticised the Central government for failing to provide a clear timeline for filling vacancies in the National Commission for Minorities (NCM), noting that key posts have remained vacant for nearly a year.
A Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia observed that the affidavit filed by the Government did not comply with earlier directions requiring a specific timeline.
Expressing its displeasure, the Bench remarked that the Court had been “taken for a ride,” pointing out that even the latest affidavit merely stated that the appointment process had been initiated and nominations were under consideration, without offering any concrete timeline.
During the hearing, the Court appreciated the fact that two members have been appointed to the commission, but maintained that the affidavit filed was not as per the court’s orders. The Court further suggested that the officer concerned be called upon to explain the ambiguity in the affidavit, prompting Additional Solicitor General Chetan Sharma to agree that further clarity was required.
The Court also recalled its earlier criticism of the government’s “bald and vague” reports and emphasised the need for accountability in ensuring timely appointments to statutory bodies.
Accordingly, the Bench directed the Deputy Secretary in the Ministry of Minority Affairs to file a proper explanation within two weeks. The matter is now scheduled for further hearing in July.
