Delhi HC dismisses half-baked petition

In a writ petition filed before the Delhi High Court seeking quashing of an order dated 07-12-2022 passed by the Central Administrative Tribunal (CAT), Principal Bench, New Delhi, a Division Bench of Justice Anil Kshetarpal and Justice Amit Mahajan found the petition to be half-baked and imposed costs on the Union (petitioner) while dismissing the same.

The Court noted that the respondent’s original application before the CAT was allowed on 20-10-2022. Thereafter, the petitioner department filed a review application, which was dismissed by the CAT on 07-12-2022. It was also noted that the present petition to set aside CAT’s order was filed after an inordinate delay of 3 years. Further, the Court noted that one of the orders challenged was not attached to the petition.

The Court found that the present petition was half-baked and dismissed it with Rs. 25,000/- as costs payable to the Poor Patients Fund, AIIMS, New Delhi, which would be recoverable from the Officer who filed the petition.

However, the Court granted liberty to file a fresh petition, together with a complete record for its adjudication, subject to payment of costs. The proof of payment was directed to be filed within two weeks.
