In a petition filed before the Delhi High Court to direct the Bar Council of Delhi (BCD) to make arrangements for casting votes to elect members of BCD in elections scheduled on 13th and 14th February, 2026, a Single Judge Bench of Justice Mini Pushkarna directed the Special Committee to treat this petition as a representation and pass an order on the same within three weeks.
The petitioner submitted that the total number of eligible voters for the upcoming elections exceeded 1,05,000 advocates, and that, since polling had previously been conducted only at the premises of the Delhi High Court, this created difficulty for advocates with matters listed elsewhere.
Apart from citing their difficulties, the petitioners submitted that managing such a large number of people and vehicles becomes impossible, thereby affecting the casting of votes in a fair manner. In response, the respondents submitted an order by the Supreme Court, which mentioned that a Special Committee had already been constituted to supervise all aspects of the elections to the BCD.
The Court perused a notification by the Bar Council of India regarding the constitution of the Special Committee and noted that the said committee had already been constituted, which had the authority to exercise all powers and perform the functions of the BCD.
Further, the Court stated that the Supreme Court order showed that, in the event of any individual grievance, the person would have the liberty to approach the High-Powered Election Committee. In the event any grievance arises from the decision of the said committee, an individual could approach the High-Powered Election Supervisory Committee constituted by the Supreme Court.
Thus, the Court directed that the present petition be considered as a representation by the Special Committee for BCD as constituted under Section 8A of the Advocates Act, 1961. The Court directed the Special Committee to consider the representation and to pass an order within three weeks.
Thus, the petition was disposed of.
