The Delhi High Court today heard a plaint alleging violation of personality and publicity rights of popular digital creator Bhuvan Bam. Justice Jyoti Singh, upon finding that the plaintiff had made out a prima facie case, passed an interim order restraining all named defendants as well as John Doe parties from any unauthorised use, reproduction, publication, distribution, sale, or commercial exploitation of Bhuvan Bam’s images, name, or likeness.
While observing that she holds a view on personality rights different from that expressed by her predecessor judges, Justice Jyoti Singh nonetheless agreed that any unauthorised use of Bhuvan Bam’s images and associated attributes could not be permitted. The Court consequently passed an omnibus order directing the takedown of all infringing products and content.
The Court further appointed local commissioners to inspect premises suspected of infringement, seize unauthorised and infringing merchandise, prepare inventories, and submit reports to the Court, thereby ensuring effective enforcement of its interim directions.
