The Bench of Justice Jyoti Singh of the Delhi High Court today heard the partition suit [CS (OS) 627/2025] filed by Ms. Samaira Kapur and another against Mrs. Priya Kapur and Master Azarias S. Kapur, seeking division of the personal assets of Late Mr. Sanjay Kapur and questioning the validity of his Will.
On behalf of Mrs. Priya Kapur and Master Azarias, it was argued that the plaintiffs had already secured beneficial interests worth over ₹1,900 crores through a Trust, that Priya Kapur had been cooperating to safeguard those interests, and that unimpeachable electronic records supported the Will. It was further submitted that the plaintiffs had themselves declined to sign a Non-Disclosure Agreement to access the Will.
The Court, while issuing notice, observed that since the suit stands registered, the doctrine of lis pendens applies. It declined interim protection to the plaintiffs, directed the defendants to file their replies within three weeks, and listed the matter for hearing on interim relief on October 9, 2025, at 2:30 p.m.
