Delhi High Court to Hear Plea Challenging Ban on Entry of Outstation BS-IV Vehicles in January

BS-IV Vehicle Ban

Two advocates have moved the Delhi High Court challenging the government notification banning the entry of BS-IV vehicles registered outside Delhi. Advocate Nipun Saxena appeared on behalf of the petitioners and pressed a limited interim request seeking recognition of lawyers as providers of essential services, so as to enable them to cross Delhi borders during the remaining working days before the court vacation.

During the hearing, the Bench noted that similar issues relating to vehicular restrictions affecting Delhi were already pending before the Supreme Court and that the High Court had earlier taken a view in comparable matters. Advocate Saxena submitted that the immediate difficulty faced by lawyers in crossing borders warranted a narrow and innocuous interim window, especially since coordinate Benches had previously recognised advocates as providing essential services.

The Court observed that the issue may receive clarity from the Supreme Court, the Bench directed that the matter be re-notified and listed in January. The Court indicated that the plea would be taken up on 12 January, keeping the request made on behalf of the advocates alive for consideration at a later stage.
