The Delhi High Court has restrained Praveen Aminigadda, YouTuber operating the channel Sipp_Smart from publishing or circulating a video disparaging Indospirit Beverages’ popular alcoholic drink BROCODE, observing that the unsubstantiated allegations in the video were prima facie defamatory and infringed the plaintiff’s trademark rights.
Justice Tejas Karia, on October 6, 2025, granted an interim injunction in the suit filed by Indospirit Beverages Pvt. Ltd. against Google LLC (operator of YouTube) and the content creator. The plaintiff alleged that a video titled “B Code Exposed!!” falsely claimed that BROCODE was “poisonous,” “deadly,” and “not fit for consumption,” misleading consumers and damaging its market reputation.
The Court noted that although the YouTuber had avoided using the full name “BROCODE,” the video and comment section clearly showed that viewers identified the product being referred to. Justice Karia held that the content amounted to disparagement and trademark infringement, observing that the video’s tone and messaging directly targeted the plaintiff’s brand without factual basis.
Finding a prima facie case and irreparable injury to the plaintiff’s goodwill, the Court directed the following:
The YouTuber must remove the video within 24 hours.
If not removed, Google/YouTube must take down the video within 72 hours of notification.
Google must also furnish subscriber and KYC details of the content creator in a sealed cover.
The plaintiff may notify Google to remove any identical reuploads of the disparaging video.
The matter will be heard next on February 4, 2026.
