The Delhi High Court directed the Municipal Corporation of Delhi (MCD) to take prompt and lawful action against ongoing unauthorized construction at Gali No. 9, Chuna Mandi, Paharganj, New Delhi. The order was passed by Justice Mini Pushkarna, who also instructed the local Station House Officer (SHO) to prevent any further illegal construction on the property.
The petitioner had approached the Court seeking immediate directions to halt the unapproved construction being carried out by Respondent No. 4, the current occupier of the property. In response, counsel for the MCD submitted documents showing that the construction had already been booked as unauthorized, and a show cause notice had been issued.
Taking the documents on record, the Court held that the MCD is bound to take necessary action under the law and directed that the process be completed expeditiously, preferably within six months. The SHO of the police station concerned was also directed to monitor and ensure no further illegal construction occurs at the site.
The Court also clarified that the occupier’s legal rights remain protected, and he may pursue remedies as per law if aggrieved by the MCD’s actions.
