Delhi High Court pulls up Advocate for appearing from Park during VC Hearing; Emphasizes Court Decorum

The Delhi High Court, while hearing bail application expressed strong disapproval of an advocate appearing via videoconferencing from a park using a mobile phone. Justice Girish Kathpalia recorded that the advocate was seen walking in a park and claimed to be present at Agra Court during the virtual appearance.

The Court reiterated that the videoconferencing facility, introduced during the COVID-19 pandemic, was meant to allow advocates to appear remotely from offices or appropriate environments not from public places like parks. Despite earlier circulars and reminders to Bar Associations to maintain decorum during virtual hearings, the issue persists.

While refusing to mark the advocate’s presence due to inappropriate appearance, the Court proceeded with the matter to avoid penalizing the litigant for the advocate’s conduct. The Court directed that nominal rolls be requisitioned and the status report be filed within two weeks, with the matter to be relisted on 14 August 2025.

The order also directed that a copy be sent to all Bar Associations across Delhi, along with a renewed request to sensitize advocates regarding professional conduct during virtual proceedings.
