The Delhi High Court has granted a dynamic injunction in favour of YMI Ghar Soaps Pvt. Ltd., restraining infringing use of its trademark “GHAR SOAPS” and directing major e-commerce platforms, including Meesho, Amazon, and Flipkart, to take down deceptive product listings.
The plaintiff alleged large-scale trademark infringement, copyright violation, and passing off through the sale of counterfeit products branded as “Hamare Ghar Ka Soaps”, which carried deceptively similar packaging. The Court observed that such listings caused irreparable harm and amounted to unfair competition, making out a prima facie case for interim relief.
Granting the plaintiff’s applications, the Court allowed filing of additional documents, exempted the matter from pre-litigation mediation under Section 12A of the Commercial Courts Act, 2015, and permitted exemption from advance service to some defendants where details were incomplete. Timelines were prescribed for filing replies, affidavits, and compliance.
The Court, presided over by Justice Manmeet Pritam Singh Arora, restrained all defendants from using the plaintiff’s brand name, packaging, or copyrighted works. E-commerce platforms were directed to block existing infringing listings, including those titled “Hamare Ghar Ka Soaps,” and prevent any further misuse of the plaintiff’s intellectual property.
Compliance affidavits are to be filed within two weeks, and the matter has been listed for further hearing on November 25, 2025.
