NGT Closes Case on Illegal Dyeing Units; 37 Found Without Consent to Operate

Illegal Dyeing Units

The National Green Tribunal, Principal Bench, New Delhi, disposed of the Original Application filed by the Applicant against illegally operating dyeing chemical units in ward no. 35, Nagar Palika Parishad Loni, District Ghaziabad, UP. The Applicant had alleged that several unauthorised small dyeing units using chemical components were operating without requisite permission from the Competent Authorities and were causing air and water pollution and creating a health hazard. The Applicant had further alleged that the chemicals discharged from these units were flowing in the drain and were affecting the quality of the groundwater.

Pursuant to its order dated 24.10.2024, the Tribunal had constituted a joint Committee with the direction to visit the site, ascertain the truthfulness of the allegations, the number of dyeing units unauthorisedly operating in the area concerned and the nature and extent of air and water pollution caused by them. The joint Committee submitted an interim report dated 31.03.2025 disclosing that out of the list of 286 units enclosed by the original applicant, the joint Committee had initially carried out the inspection and found 17 illegal dyeing units on 01.02.2025 and 09.02.2025 and these units were closed down.

The joint Committee filed the final report dated 04.08.2025, disclosing that the inspection of the remaining 175 was conducted, out of which 24 units were found to be illegally operating. The Committee found that there are 50 dyeing industries in the said area out of which 34 dyeing industries were found to be operating without CTO and 16 were found to be having valid CTO. Further, 03 electroplating units were also found being operated without having CTO from UPPCB. Therefore, total 37 industries were found to be operating without valid CTO.

Accordingly, the bench comprising Mr. Justice Prakash Shrivastava, Chairperson, Mr. Justice Sudhir Agarwal, Judicial Member, and Dr. A. Senthil Vel, Expert Member, noted that the joint Committee had carried out the inspection of all 286 industries and had identified the dyeing units which were illegally operating, and action had also been initiated against them. The Tribunal directed that the District Magistrate, Ghaziabad, would ensure that a proper time-bound action plan is prepared to prevent the discharge of industrial effluent and untreated sewage in Indrapuri drain within three months. The Original Application was accordingly disposed of.
