At Delhi Arbitration Weekend 2025 (DAW 2025), Justice Suryakant, Judge, Supreme Court of India, joined us for an exclusive conversation on India’s journey toward becoming a truly pro-arbitration jurisdiction.
1. What can be done to solidify India’s arbitration framework and reduce judicial interference?
Justice Surya Kant: As I mentioned, India’s commitment to becoming the most preferred destination for arbitration is clearly visible. This is being achieved not only through the policy of minimal judicial intervention but also through the growing popularity of institutional arbitration in India. The emphasis on party autonomy, coupled with the emergence of a strong arbitral bar, are very encouraging signs. All these developments indicate that India is on the right path to becoming one of the most preferred arbitration hubs in the near future.
2. How impactful are events like the Delhi Arbitration Weekend (DAW) in enhancing the reputation of Indian arbitrators and institutions globally?
Justice Surya Kant: These are very welcome initiatives. When leading thinkers and practitioners in the field of arbitration come together to deliberate, they exchange best practices and discuss the challenges faced by different jurisdictions. Such platforms are not only about identifying problems but also about finding solutions. This exchange of ideas helps arbitration evolve and progress in a meaningful way.
3. If you had to describe the Delhi Arbitration Weekend in one word?
Justice Surya Kant: I would describe it in a few words, a fantastic event and a march forward towards a brighter future for arbitration in India.
