J&K High Court stays Police Notices; Grants Interim Protection

Owais Mansoor v. UT of J&K [Decided on 09.07.2025]

The Jammu and Kashmir High Court granted interim relief to the petitioner by staying the operation of two impugned notices issued by the Station House Officer (SHO), Police Station Bhaderwah, and restrained the respondents from causing any illegal harassment.

Justice Mohd. Yousuf Wani, while hearing the matter found that a prima facie case had been made out for the grant of interim relief. The impugned police notices No. 609/5-1/PSB dated June 24, 2025, and No. 626/5-1/PSB dated June 28, 2024 were directed to remain in abeyance pending further orders of the court.

The Court also issued notice to the respondents in both the main petition and the interim application, returnable within four weeks, subject to the petitioner taking necessary steps for service within one week. Listing the matter for August 22, 2025, the Court clarified that the interim relief would remain effective unless modified or vacated based on the respondents’ objections.

Additionally, the Court allowed the petitioner’s application for exemption from filing certified copies of annexures at this stage, with the direction to produce them if called for later.
