The Kerala High Court has directed the Government of India to expeditiously consider the representation of Justice (Retd.) C.K. Abdul Rehim for re-induction as Chairman of the Kerala Administrative Tribunal (KAT). Justice Rehim, who served as KAT Chairman from 6th September 2021 to 5th September 2025, contended that under the Supreme Court rulings in Madras Bar Association v. Union of India [(2021) 7 SCC 369 and a 2025 judgment, his tenure should have been five years from the date of assumption of office, entitling him to continue until 5th September 2026.
The petitioner argued that his selection under the parent statute, the Administrative Tribunal Act, 1985 was completed before the Tribunal Reforms Act, 2021 came into effect, and thus the appointment and service conditions should be protected.
The High Court noted that his representation was pending and directed the Department of Personnel & Training, to decide on it within one month, leaving substantive legal issues open for consideration.
