The Kerala High Court has issued notice on a writ petition seeking urgent directions against alleged professional misconduct by an advocate accused of withholding case files despite repeated requests and tribunal directions.
The petition alleges that the advocate refused to return the petitioner’s case files related to a pending Motor Accidents Claims Tribunal (MACT) matter, even after multiple written requests and specific directions issued by the Tribunal. It is further claimed that the advocate sent unsigned relinquishment letters and issued veiled threats through WhatsApp communications.
According to the petitioner, the MACT, Ernakulam, after noting persistent non-compliance by the advocate, directed him to approach the Bar Council of Kerala for appropriate action. A detailed disciplinary complaint was subsequently filed; however, no steps have been taken by the Bar Council to consider or dispose of the complaint.
The petitioner has contended that this inaction has caused serious prejudice to his pending claim proceedings. He has also highlighted his medical condition and stated that he is the sole earning member of his family, with two minor children dependent on him, making the matter urgent and directly impacting his livelihood.
The High Court, upon hearing the matter, has issued notice to the respondents, including the advocate concerned, and posted the case for further consideration.
