Madhya Pradesh High Court Grants Interim Relief to Teacher Challenging Frequent Transfers

Param Singh v. State of MP [Decided on 9th July, 2025]

The Madhya Pradesh High Court granted interim relief to a primary school teacher, who had challenged his latest transfer order on grounds of frequent and premature postings.

The petitioner, currently posted as a Primary Teacher (Science) at Government Higher Secondary School, Luharee, had been transferred via order dated 16 June 2025 to Government High School, Samnapur. He submitted that this was his third transfer in less than three years, and he had not been allowed to complete his normal tenure at any post.

The petitioner’s counsel argued that such repeated transfers, without justification, violated norms regarding minimum tenure and caused professional and personal hardship. The State, represented by the Government Advocate, submitted that the transfer was made due to administrative exigency, but agreed that the petitioner’s representation dated 23 June 2025 would be considered.

Taking note of the submissions, Justice Maninder S. Bhatti disposed of the petition with a direction to the District Education Officer, Damoh to decide on the petitioner’s representation within 30 days, through a well-reasoned and speaking order in accordance with law.

Until such decision is made, the Court ordered that the petitioner shall continue at his current posting at Government Higher Secondary School, Luharee, Block Patera.
