Meghalaya High Court Admits PIL on Issuance of Scheduled Tribe Certificates to Khasis

The Meghalaya High Court has formally admitted a PIL filed by the registered society Syngkhong Rympei Thymmai, raising concerns over the issuance of Scheduled Tribe certificates to members of the Khasi community. The PIL, argued by Mr. N. Syngkon and Ms. L. Phanjom, challenges a recent policy shift by the Social Welfare Department.

The controversy began when, on 21st July 2020, the Department endorsed advice from the District Council Affairs Department stating that Scheduled Tribe certificates could be issued to applicants adopting surnames from either parent, or to non-Khasi women taking their husband’s surname. However, this position was withdrawn on 21st May 2024, reportedly halting the issuance of ST certificates to certain eligible Khasi individuals.

The petitioner argued that this reversal has affected legitimate claims under the Khasi Hills Autonomous District (Khasi Social Custom of Lineage) Act, 1997, which recognizes individuals as Khasi even if only one parent belongs to the tribe. The Court questioned how adopting a surname from either parent could negate the statutory right to a tribe certificate under the Act.

The Bench comprising Chief Justice I.P. Mukerji and Justice W. Diengdoh directed the District Council Affairs Department to submit a detailed report on its position regarding surname choices and ST certificate eligibility. The matter has been listed for further hearing on 23rd July 2025. The Court also directed that all respondents be served with copies of the petition to ensure transparency and proper hearing.
