The Madhya Pradesh High Court at Jabalpur, while hearing a second bail application in expressed displeasure over misleading submissions made and cautioned counsel to adhere to fairness and transparency in court proceedings.
The case came up before Justice Sandeep N. Bhatt and during the hearing, counsel for the objector pointed out that the petitioner had already withdrawn his second bail application through a written submission filed from jail on January 7, 2026. However, the petitioner’s counsel initially denied the existence of any such averment in the application.
Upon perusing the trial court record, the High Court found that the application indeed contained a clear statement that the bail plea had been withdrawn. When confronted with this, counsel for the petitioner submitted that there had been a “communication gap” between him and the petitioner, as the latter had filed the application directly from jail, without the counsel’s knowledge.
Taking note of the incident, the Court noted the importance of pleadings and responsible submissions by advocates. Justice Bhatt observed that pleadings form the very foundation of judicial proceedings and that any submission made at the Bar must be preceded by proper verification of facts.
Although the Court refrained from making further adverse observations, it recorded its displeasure over the misleading statement made during the hearing. The Court reminded the counsel of their duty to assist the judiciary in a fair and transparent manner, without concealing material facts or making incorrect representations.
In view of the circumstances, the High Court permitted the petitioner to withdraw the bail application and dismissed it as withdrawn.
