In an application filed before the National Green Tribunal, Principal Bench, New Delhi, based on an action taken report filed by the Delhi Pollution Control Committee (DPCC) in compliance with the Tribunal’s order dated 23-02-2024 in an Original Application, a Bench of Justice Prakash Shrivastava (Chairperson) and Dr. A. Senthil Vel (Expert Member) directed Public Works Department (PWD), GNCTD to take appropriate measures for cleaning the subject drain and to submit a report within six weeks.
The said OA, registered on the basis of a letter petition by Hari Kunj Residents Welfare Association, MIG Flats, Hari Nagar, New Delhi, raised grievances against Dhalao No. 132 (dumping yard) constructed on the green belt area of Hanuman Park, which was in a dilapidated condition and solid waste was being scattered, creating a health hazard.
While disposing of the OA, the Tribunal permitted the applicant to file a detailed complaint with the Deputy Commissioner, West Zone, and the Member Secretary, DPCC, who were directed to conduct a spot inspection and take appropriate remedial action. DPCC’s report reflected that the Tribunal’s order had not been complied with. It was stated that there was garbage on half of the road adjacent to the park, and that the dumping yard was located at the boundary of Hanuman Park, from which the garbage was spread to the main road drain, thereby clogging it.
Therefore, by proceedings dated 01-08-2025, the Tribunal impleaded the Municipal Corporation of Delhi (MCD) and DPCC. Later, by proceedings dated 03-11-2025, the Secretary, Public Works Department (PWD), GNCTD, had also been impleaded. The status report filed by the MCD revealed that the said dumping yard had been closed and cleaned.
The Court noted that PWD, GNCTD, which was responsible for maintaining the clogged main drain, had not filed any report.
Thus, the Court directed PWD, GNCTD, to take appropriate measures for cleaning the said drain if it was still clogged and to submit an action taken report within six weeks. The Court disposed of the matter, stating that, if necessary, the matter would be listed for reconsideration.
