NGT Takes Cognizance of Illegal Construction During GRAP-III & IV, Issues Notice and Directs CAQM to Act

Illegal construction during GRAP

The National Green Tribunal, Principal Bench, New Delhi, has issued notice in a plea alleging that large-scale construction and demolition activities were being carried out within an office campus in Delhi in violation of GRAP-III and GRAP-IV restrictions.

The Bench comprising Justice Prakash Shrivastava (Chairperson) and Dr. A. Senthil Vel (Expert Member) was hearing an Application which alleged that Respondent No. 4 was undertaking construction work involving around 80 washrooms from 22 November 2025 onwards, despite the prevailing air pollution restrictions.

The applicant submitted that he has a two-month-old infant daughter with serious health issues and that he himself is suffering from allergic bronchitis, forcing him to stay away from his child due to worsening air quality. On account of the health complications and related medical expenses, the applicant sought compensation of ₹7.11 lakh.

It was further pointed out that complaints were lodged on 22 November 2025 through the Green Delhi App, as well as with the Commission for Air Quality Management (CAQM), but no action had been taken. The applicant placed photographs on record to demonstrate that construction activities were ongoing at the site.

Observing that the application raises substantial issues relating to compliance with environmental norms, the Tribunal issued notice to the respondents. The NGT directed the applicant to serve the respondents and file an affidavit of service at least one week before the next hearing.

The Tribunal also directed the CAQM to consider the applicant’s complaint, conduct a ground verification, ascertain any violations, and take appropriate remedial and punitive action in accordance with law within ten days. The CAQM has been asked to file an action taken report at least one week before the next date of hearing.

The matter has been listed for further consideration on 17 February 2026.
