In an original application registered before the National Green Tribunal (Principal Bench), New Delhi, based upon a letter petition dated 31-07-2025 by the applicant, for the exercise of suo motu jurisdiction as per the law laid down by the Supreme Court in Municipal Corporation of Greater Mumbai v. Ankita Sinha (2022) 13 SCC 401, a Coram of Justice Arun Kumar Tyagi (Judicial Member) and Dr. Afroz Ahmad (Expert Member) transferred the matter to the Western Zone Bench of the Tribunal at Pune while granting the applicant another opportunity for appearance.
The subject of the letter-petition sent by the applicant NGO was to take action regarding the environmental danger posed by Poladpur Nagar Parishad, District Raigad, for dumping hazardous garbage directly into the Savitri River. It was contended that the Poladpur Nagar Parishad used to award tenders to contractors for dumping garbage without allotting a specific dumping ground, which is why the contractors dump the waste directly into the river.
Even though the applicant failed to appear before the Tribunal, they were granted another opportunity by the Tribunal to appear in view of the nature of the environmental issues raised.
Further, the Tribunal noted that the place of accrual of the cause of action in the present matter was within the jurisdiction of the Western Zone Bench at Pune and accordingly ordered that further hearings be conducted at Pune. Thus, the Court directed the Registry to list the matter before the Western Zone Bench on 10-02-2026 after obtaining the required orders from the Chairperson.
Lastly, the Court directed the Registry to inform the applicant about the next date of hearing and to ask him to appear at Pune with the material available in support of the averments made.
