Rani Kapur, widow of late industrialist Dr. Surinder Kapur and matriarch of the Kapur family, has approached the Delhi High Court seeking a declaration that the purported “RK Family Trust” is null and void, alleging that it was fraudulently created to divest her of her entire estate, including her controlling stake in the Sona Group of Companies.
In her suit, Kapur claims that she is the sole beneficiary of her late husband’s duly probated Will dated February 6, 2013, under which all his movable and immovable assets were bequeathed exclusively to her.
However, she alleges that a trust deed dated October 26, 2017, of which she was neither consciously aware nor had knowingly executed was used to transfer all her assets into the so-called RK Family Trust, effectively excluding her as a beneficiary.
Rani Kapur has further alleged that the signatures attributed to her on the trust deed are forged and do not match her genuine signatures. She also claims that despite being shown as the settlor and trustee of the trust, she was never provided with the original trust deed or informed of its contents and functioning.
The suit seeks cancellation of the trust deed, a permanent injunction restraining the defendants from dealing with her assets, and rendition of accounts, alleging a systematic conspiracy involving her late son’s wife and several associates to usurp control over her wealth and business interests.
