The Supreme Court has dismissed a civil appeal filed by Abhijit Realtors and Infraventures Pvt. Ltd., holding that no purpose would be served in examining the merits of the case after the resolution plan had already been implemented.
The Bench comprising Justices Sanjay Kumar and K. Vinod Chandran noted that the resolution plan in question had been approved by the adjudicating authority on May 6, 2024, and subsequently upheld by the National Company Law Appellate Tribunal (NCLAT) on December 23, 2024.
Although the appeal was initially filed before the Supreme Court shortly thereafter, it was defective and refiled with a delay of 100 days. The matter came up for consideration only in May 2025, when the delay was condoned and notice was issued.
However, by that time, the Court noted, the resolution plan had already been acted upon and fully implemented, with payments disbursed to financial creditors and other stakeholders in April 2025.
In view of these developments, the Court held that examining the merits of the challenge at such a belated stage would serve no meaningful purpose. Consequently, the appeal was dismissed on this short ground, and all pending applications were disposed of.
