SC stays P&H HC Order in Habeas Corpus Plea by Punjab Police Constable Seeking Custody of Children

Veenus Rani v. State of Punjab [Decided on 28.04.2025]

The Supreme Court has stayed the operation of a Punjab and Haryana High Court order dated February 21, 2025, which had directed that a woman constable with Punjab Police to hand over the custody of her two minor children to her estranged husband by April 1, 2025. The Court issued notice in the special leave petition filed by the woman and posted the matter for hearing on July 28, 2025.

The Court bench comprising Justices M.M. Sundresh and Rajesh Bindal, after hearing the petitioner’s counsel and noting preliminary arguments, granted interim relief by staying the High Court’s order, thereby allowing the children to remain with the mother pending further hearing.

The matter arises amidst serious allegations made by the petitioner against her husband, including his involvement in criminal cases and claims of mistreatment of the children.
