The Supreme Court, led by Chief Justice of India Surya Kant and Justice Joymalya Bagchi, highlighted the careful use of Artificial Intelligence (AI) in judicial proceedings while hearing a PIL seeking regulation of generative AI in courts. The bench clarified that there is no “unregulated” use of AI in the judiciary and noted that judges aim to ensure AI does not influence judicial decision-making.
The CJI also noted concerns regarding AI-generated fake precedents cited by advocates and stressed that lawyers must remain vigilant to avoid reliance on fabricated material. The bench referenced the Supreme Court’s white paper on AI and acknowledged Kerala High Court’s policy on responsible AI use in its district judiciary. The Court allowed suggestions on AI guidelines to be submitted administratively and dismissed the PIL as withdrawn.
