Supreme Court Declines CBI Probe In Uttam Nagar Holi Incident; Asks Petitioner To Approach Delhi Police First

CBI Probe Denied Holi Incident

The Supreme Court today declined to entertain a plea seeking directions in connection with the death of a 27-year-old man, Tarun Butolia, in the Uttam Nagar incident, observing that the issues raised were largely administrative and could be addressed by the Delhi Police.

Appearing for the petitioners, Advocate Hari Shankar Jain alleged that the case involved a “brutal incident of lynching.” However, the Bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice Vipul M Pancholi expressed reluctance to transfer the investigation to the CBI at the threshold.

“Every day CBI officers come here and say their plate is full. Delhi Police is a professional force, why demoralise them?” the CJI remarked, adding that if there are concerns regarding sensitisation or handling of the case, the petitioner should first approach the Commissioner of Police.

In its order, the Court noted that the directions sought, particularly regarding the safety and security of the victim’s family, fall within the administrative domain of the police.

“We find that some of the directions sought are administrative in nature concerning safety and security of the victim’s family. The Delhi Police can look into it,” the Court recorded.

Granting liberty, the Court permitted the petitioner to submit a comprehensive representation to the Commissioner of Police, who shall assess any threat perception and take remedial measures as required. The Court further clarified that if the petitioner’s grievances are not adequately addressed, they would be at liberty to approach the Delhi High Court. The plea was accordingly disposed of.
