The Chief Justice Surya Kant on Wednesday expressed serious concern over an attempt to improperly influence proceedings by calling his brother to dictate the order. CJI warned of strict consequences and emphasising that such conduct would not be tolerated.
“He called my brother and asked how did I pass this order? Questioning the chief justice of India ! I have handled such elements from the last 23 years. Please ask him to furnish why should we not proceed in criminal contempt against him.”
The case arose from a plea where the petitioner, after converting from the upper-caste General category, sought benefits under a Buddhist certificate for postgraduate medical admission. The Court had earlier directed the Chief Secretary of Haryana to place on record the guidelines governing the issuance of such minority certificates. However, no compliance report has been filed so far.
“We have not received that report… it is said that someone called my brother on the phone and told him that he would dictate. As counsel, you should first withdraw if your client is misconducting..And even if someone hides outside India, I know how to deal with such people. Never ever dare to do this. Sometimes you think that we will transfer the case, don’t do this. I have dealt with such elements,” the CJI said sternly.
When counsel responded that he was unaware of any such incident, the CJI remained unconvinced and cautioned against any indirect attempts to influence the process.
“You verify… I think you are manipulating there also, this is what you are doing,” the Bench said.
